H-2B VISA 

 

 

 

The H-2B visa nonimmigrant program permits employers to hire foreign workers to come temporarily to the United States and perform temporary nonagricultural services or labor on a one-time, seasonal, peak load or intermittent basis.

 

The H-2B visa classification requires the United States Secretary of Homeland Security (DHS) to consult with appropriate agencies before admitting H-2B nonimmigrants. Homeland Security regulations require that, except for Guam, the petitioning employer first apply for a temporary labor certification from the United States Secretary of Labor indicating that: (1) there are not sufficient U.S. workers who are capable of performing the temporary services or labor at the time of filing the petition for H-2B classification and at the place where the foreign worker is to perform the work; and (2) the employment of the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers. The Department of Labor will review and process all H-2B applications and issue its certification as a recommendation only to the USCIS/DHS for final approval.

 

Employers seeking to employ temporary H-2B workers must apply for Temporary Employment Certification to the Chicago National Processing Center (NPC). Once certified the employer must apply for the issuance of the VISA with the applicable USCIS Service Center.  An employer may submit a request for multiple unnamed foreign workers as long as each worker is to perform the same services or labor, on the same terms and conditions, in the same occupation, in the same area of intended employment during the same period of employment. Certification & VISA are issued to the employer, not the worker, and are not transferable from one employer to another or from one worker to another.

WHAT WE DO

 

As your agent of record, Workforce Advantage provides complete H2-B services for a flat fee, which includes the required government application and Premium Processing fees. Employer’s will be responsible for covering the cost of their own advertising fees in compliance with program requirements.

 

As part of the fee structure, WFA provides the following support to each employer:

 

  • Develop and submit appropriate pre-application materials to the USDOL Chicago National Processing Center (CNPC) and State Workforce Agency 

  • Request the applicable Prevailing Wage Rates from the USDOL

  • Coordinate the required positive recruitment effort including opening the required state job order, scheduling newspaper advertisements and assisting with the required recruitment summary.  

  • Develop the appropriate documentation disclosing the worker Terms of Employment (ToE) for use by foreign recruitment agencies

  • Coordinate with foreign agencies for the contact and scheduling of workers as well as their transportation to your place of business   

  • Coordinate VISA issuance by the U.S. State Department Consulate or Embassy in the worker’s country of origin.

 
H-2A VISA 

 

 

 

The H-2A temporary agricultural program establishes a means for agricultural employers who anticipate a shortage of domestic workers to bring nonimmigrant foreign workers to the U.S. to perform agricultural labor or services of a temporary or seasonal nature.

 

Tens of thousands of foreign workers enter the United States every season to harvest agricultural products for which there are simply not enough available laborers to meet employers needs each season.
